Pfizer Sued by Families of Nigerian Children

NEW YORK (Reuters) - Pfizer Inc. was sued on Wednesday by the families
of about 30 Nigerian children who either died or suffered serious
injury after unwittingly participating in a test of an experimental
meningitis drug.

The suit, filed in Manhattan federal court, alleged that Pfizer
violated international law by never obtaining informed consent from
the children or their parents before giving injections of the drug
called Trovan. The plaintiffs in the suit include families of seven
children who died.

The suit, which seeks unspecified damages, alleged that the test
resulted in such serious injuries as brain damage, loss of hearing,
and full loss of motor skills.

A Pfizer spokesman could not be reached for comment.

The litigation involves Pfizer's actions during 1996 epidemics of
bacterial meningitis, measles and cholera in Nigeria. The suit alleged
that Pfizer representatives traveled to Kano to test the experimental
drug in the impoverished and strife-torn city in Northern Nigeria.

``But rather than making the trip to provide humanitarian relief, as
charitable organizations were doing, Pfizer hurried to Kano to exploit
the misfortune there for its own benefit,'' the suit alleged.

The suit claims that the drug company did not obtain consent and did
not explain that the proposed treatment was experimental.

It further alleged that Pfizer did not tell parents they were free to
refuse the drug and instead choose a safe, effective treatment for
bacterial meningitis being offered at the same site free of charge by
a charitable medical group.

The suit alleged that Pfizer chose 200 children for its test. After
the children were selected, they were taken from their parents and
split into two groups, the suit alleged. Half of the children were
given Trovan and five died. The suit alleged that the drug was given
in a form never before tested on humans and which was known to have
life-threatening side effects.

The other half were given low doses of a control drug called
ceftriazone, an effective meningitis drug approved by the Food and
Drug Administration (news - web sites).

The suit alleged that the low dosing resulted in injuries and six
deaths among the control group. The plaintiffs alleged that the
results from the control group aided Pfizer in its claim that Trovan
was efficacious and perhaps more efficacious than the other drugs on
the market.

In March, a Kano federal high court ruled that parents of children who
were treated with Trovan could sue Pfizer for administering the
controversial vaccine without their prior consent.
